These short message service (SMS) Terms and Conditions (the “SMS Terms”) apply to the text and email messaging offered by the Maryland Information Network 2-1-1 Maryland, Inc. (211 Maryland) (such text and email messaging referred to as “Text Messaging Alerts”). YOU ARE EXPECTED TO REVIEW THESE SMS TERMS BEFORE SIGNING UP FOR ANY TEXT MESSAGING SERVICES THAT ARE AVAILABLE THROUGH THE 211 MARYLAND SITE. These terms are distinct from the 211 Maryland terms of use governing the use of 211 Maryland’s website, found HERE. Please also see 211 Maryland’s Privacy Policy for a summary of 211 Maryland’s personally identifiable information collection and use practices.

Opt-In.

The number of 211 Maryland text messages that you receive will vary depending on how many of 211 Maryland’s text messaging program you join, designate, or select. To opt-in to a Text Messaging Alerts program, text the keyword for the program you want to join to 898-211 or 211-MD1, depending on the program. Such keywords can be found HERE to opt-in to 211 Maryland Text Messaging Alert programs. Msg&data rates may apply to all of the above.

By texting the keyword to “TXT-211” (898-211), subscribers can expect to receive the following types of messages:

  • Information and education that comes from partnerships and work completed by 211 Maryland service providers and its affiliates, partners, and stakeholders. Region-specific alerts will include information regarding adult and teen mental health, kinship, hate crimes, aging and disability, opioids, wellness, and veterans and disaster preparedness.

By texting the keyword, "HealthCheck" to “211-MD1” (211-631), subscribers can expect to receive the following types of messages:

  • Information and education that comes from partnerships and work completed by 211 Maryland service providers and its affiliates, partners, and stakeholders. Region-specific alerts will include information regarding mental health/health check.

By texting the keyword, “MdReady” or "MdListo" for Spanish to "211-MD1" (211-631) subscribers can expect to receive the following types of messages:

  • Up to the minute disaster alerts, during and post disaster, affecting your community (based on the ZIP code or keyword you provide when you subscribe for MdReady Alerts).

Delayed Or Undelivered Messages.

Alerts sent via SMS may not be delivered to you if your phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of your wireless carrier may interfere with message delivery, including the customer’s equipment, terrain, proximity to buildings, foliage, and weather. You acknowledge that urgent alerts may not be timely received and that your wireless carrier does not guarantee that alerts will be delivered.

If you change or disconnect your mobile number, it is your responsibility to notify 211 Maryland of this change by texting STOP to the number you subscribed to.

Opt Out.

To stop receiving text messages from the 211 Maryland Text Messaging Alerts programs, text STOP to 898-211 at any time to remove your number from all of 211 Maryland’s Text Messaging Alerts programs, and to receive no further messages from 211 Maryland unless you re-subscribe per the instructions above.  You will then receive confirmation of your opt-out of the Text Messaging Alerts programs.

Use Of Information And Services.

211 Maryland’s Text Messaging Alerts is not a substitute for 9-1-1 (emergency services), 4-1-1 (telephone directory assistance) or other specialized hotlines or automated recordings. While 211 Maryland’s Text Messaging Alerts support individuals with hearing/speech impairments, the Text Messaging Alerts are also not a substitute for 7-1-1 (hearing or speaking limitations services).

The information and services provided by 211 Maryland’s Text Messaging Alerts are for informational purposes only, and reliance on the information provided via the Text Message Alerts is solely at your own risk.

The information, services, and materials of 211 Maryland’s Text Messaging Alerts are provided on an “as is” basis with no warranty. To the maximum extent permitted by applicable law, 211 Maryland disclaims all representations and warranties, express or implied, with respect to such information, services, products, and materials, including without limitation any implied warranties of merchantability, fitness for a particular purpose and noninfringement.

In no event will 211 Maryland be liable for any consequential, indirect, incidental, special, or punitive damages, however caused and under any theory of liability (including negligence), arising from your use of 211 Maryland’s Text Messaging Alerts or the provision of the information, services, products, and materials provided by 211 Maryland’s Text Messaging Alerts, even if 211 Maryland has been advised of the possibility of such damages.

You represent that you are the account holder for the mobile or telephone number(s) that you provide. You are responsible for notifying 211 Maryland immediately if you change your mobile telephone number.

External Sites.

211 Maryland’s Text Messaging Alerts may provide links to other sites on the Internet that are owned and operated by third parties. You acknowledge that 211 Maryland is not responsible for the availability of, or the content located on or through, any such external site.

Termination Of Usage.

211 Maryland may terminate or suspend your access to all or part of 211 Maryland’s Text Messaging Alerts services, without notice, for any conduct that 211 Maryland, in its sole discretion, believes is in violation of any applicable law or is harmful to the interests of another user, a sponsor, merchant, or other third party, or 211 Maryland’s Text Messaging Alerts services.

Modification Of Terms And Conditions.

211 Maryland reserves the right, at any time, to modify, alter or update these SMS Terms by posting a revised SMS Terms or mailing and/or e-mailing notice thereof to you. You agree to be bound by such modifications, alterations, or updates, unless you opt-out of receiving the Text Messaging Alerts (as set forth above). Accordingly, you are expected to review these SMS Terms on a periodic basis.

Governing Law.

The 211 Maryland Text Messaging Alerts are governed by the laws of the state of Maryland.
